Terms of Service

EFFECTIVE15 October 2026 VERSION2026-10-15

These Terms govern your use of audesti, the voice-testimonial platform at audesti.com, app.audesti.com, and the APIs and connectors described below ("audesti", "we", "us").

By creating an account, or by using the Service on behalf of an organisation, you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind it, and "you" means that organisation.

This document has three parts. Part A is the agreement itself. Part B is the Acceptable Use Policy and Part C the Refund & Cancellation Policy; both form part of these Terms and breaching Part B is a material breach. The Privacy Policy is incorporated by reference. Where you process personal data of people in the EU, UK or India through the Service, the Data Processing Addendum also applies.

If you were invited to record a testimonial and are not an audesti customer, the short section immediately below is written for you. You are not a party to the agreement that follows it.

Guests

For guests: if someone has asked you to record

You do not need an account, and you are not a party to the agreement that follows. This short section tells you where you stand; the Privacy Policy has the detail.

  • What happens. You record in your browser. Your recording is transcribed automatically, and a lightly tidied version of the transcript — same meaning, cleaner wording — is shown alongside it. Your recording itself plays in your own words, with background noise reduced and the volume evened out. Nothing is rewritten into words you did not say, and the verbatim transcript is kept.
  • Who decides what happens next. The business that invited you, not audesti. We handle your recording on their instructions.
  • Publication is a separate yes. Ticking the required consent box lets the business collect and review your testimonial. It does not make it public. Publishing it on an audesti public page or as a shareable quote card needs the separate, optional permission you can give on the recording page or by answering a later email. You may decline, and declining changes nothing else.
  • Changing your mind. Ask the business that invited you and they can unpublish it. To have the recording itself deleted, email [email protected] with enough detail to find it — the recording link, or roughly when you recorded and the name you used.
  • Your rights. Depending on where you live, you may have rights of access, correction, deletion, objection and portability. Clause 9 of the Privacy Policy explains how to exercise them and whom to ask, and clause 15 covers the EU, the UK and India specifically.
Part A

The agreement

01Who may use audesti

You must be 18 or older. You must not use the Service if we have previously terminated your account, or if applicable law bars you from receiving it.

02What the Service does

audesti lets you invite a guest to record a short voice testimonial in their browser. We transcribe the recording, produce a lightly edited version of the transcript, analyse it automatically, and give you tools to review, approve, publish and embed the result.

Specifically, the Service:

  • generates invitation links and optionally emails them to guests you name;
  • records audio in the guest's browser and stores it;
  • transcribes the recording and produces a clean-up copy of the audio for playback;
  • produces an edited transcript for display, while retaining the verbatim transcript;
  • analyses the transcript for topics, sentiment, feature mentions, pain points, quotable phrases, competitor references and stated outcomes;
  • publishes approved testimonials through embeddable widgets, audesti-hosted share pages and a public showcase page, where the relevant permissions exist (clause 6);
  • exposes your own data to you through a REST API and an MCP connector on paid plans.

Guests do not create accounts. Features change; we may add, modify or withdraw functionality, and will not remove a materially significant feature from a paid plan without reasonable notice.

03Your account

You are responsible for everything done under your account, for keeping your sign-in credentials and API keys secure, and for the acts of every team member you invite. Tell us promptly at [email protected] if you believe your account or API key has been compromised.

Accounts are organised as teams. All content belongs to the team owner's account; team members act on it within the limits their plan allows. If a team owner deletes their account, the team's content goes with it and members become independent accounts.

04Plans, quotas and billing

Plan prices, quotas and included features are shown on the pricing page and are the operative terms. Note that quotas differ in kind:

  • the Free plan's testimonial allowance is a lifetime total, not a monthly one, plus one additional testimonial for each successful referral;
  • paid plans' testimonial allowances reset at the start of each calendar month.

Once a quota is reached, new testimonials cannot be collected until you upgrade or, on paid plans, the next month begins. Quotas exist because each testimonial incurs real transcription, analysis and storage cost.

Payments are taken by Dodo Payments, which acts as merchant of record and as an independent controller of your payment data. We never receive or store your card or bank details. Subscriptions renew automatically for the interval you chose until cancelled. Prices are exclusive of taxes unless stated otherwise at checkout; you are responsible for any tax, duty or statutory charge arising on your purchase, other than taxes on our income.

We may change prices. For existing subscriptions, a price change takes effect at the start of the next billing period after at least 30 days' notice to your account email.

Refunds, cancellation and what happens when a subscription lapses are governed by Part C.

05Your obligations when collecting testimonials

You decide who to invite and why. That makes you responsible, as the controller of that personal data, for the lawfulness of each collection. You agree that:

  • you have a lawful basis to contact each guest and to invite them to record;
  • the guest details you enter — name, email, company, designation — are accurate and were obtained lawfully;
  • you will not bypass, suppress, pre-fill or interfere with the consent step on the recording page, nor present it to anyone other than the guest it was issued for;
  • you will not offer, and have not offered, payment or other material inducement in exchange for a particular opinion, and will disclose any material connection with a guest where the law requires it;
  • you will not edit, excerpt, caption or arrange a testimonial in a way that changes its meaning or creates a misleading impression of what the guest said;
  • you will not present an audesti testimonial as independently verified beyond what it is — a recording made by someone you invited, who confirmed their consent on the page.

These obligations exist because testimonial advertising is regulated in most markets we operate in. Breaching them is a material breach of these Terms.

06Publication and guest permissions

Two different permissions govern where a testimonial may appear, and you must respect both.

Approval (yours). No testimonial is published anywhere until you approve it. An approved testimonial may be shown in embed widgets you place on sites you control. Placing a widget on your own site is your decision and your responsibility.

Publication consent (the guest's). audesti-hosted public surfaces — the share page at /s/<code>, its share-card image, and your public showcase page at /reviews/<slug>, which is indexed by search engines — require the guest's separate, optional opt-in. A guest gives that opt-in on the recording page or by answering a share-permission email. Without it, those surfaces stay closed.

Withdrawal. A guest may ask you to stop publishing at any time. There is no guest login, so the guest asks you and you record it in the app. Doing so removes the testimonial from the share page and showcase page immediately and deletes the share card. It does not remove it from widgets already placed on your own site; taking it down there is your responsibility, and you agree to do so promptly when a guest asks.

You agree to act on a guest's withdrawal request without delay, and not to re-publish a testimonial whose consent has been withdrawn.

07Content and licences

Ownership. Guests retain all rights in their voice and their recording. You retain all rights in the content you supply and in the testimonials you collect. We claim no ownership of either.

Licence to us. You grant us, and you confirm the guest grants us, a non-exclusive, worldwide, royalty-free licence to host, store, transcribe, translate, analyse, reproduce, adapt (only as needed to produce the edited transcript, cleaned audio, translations and share cards) and transmit the content, solely to operate and support the Service for you. The licence ends when the content is deleted, except for copies we must retain by law.

No training. We do not use your content, your guests' recordings or their transcripts to train our own models, and we do not permit our AI sub-processors to use them to train theirs.

Your feedback. If you send us suggestions, we may use them without obligation to you.

08Automated processing, and its limits

Transcription, transcript editing, translation and analysis are performed entirely by automated systems. No person at audesti listens to or reads your recordings as a matter of course; we access content only where you ask us to for support, or where we must to investigate abuse, secure the Service or comply with law.

Automated output is probabilistic. Transcripts may contain errors, and the edited transcript may differ in wording from what was said — which is why the verbatim transcript is always retained and visible to you. Sentiment, topics, competitor mentions and stated outcomes are inferences, not findings of fact.

You must not use the Service, or its output, as an input to decisions about a person's employment, health, credit, insurance, housing, education, immigration status or legal rights, or for any other decision producing legal or similarly significant effects. The Service is not designed, tested or offered for those purposes.

09API access, AI assistants (MCP) and widgets

On plans that include them, audesti can be reached three further ways beyond the app itself. Each carries the obligations below, and in each case you remain fully responsible for what happens under your account.

REST API. A key issued on your account authenticates every call. Keep it confidential, rotate it if exposed, stay inside published rate limits, and do not circumvent them.

MCP connector (AI assistant access). You may connect an AI assistant — Claude or another MCP client — to your account. Connecting requires you to sign in and approve the connection through an OAuth consent screen; the assistant never receives your password. A connection is granted one of two scopes:

  • read — the assistant may list and read your testimonials, their transcripts and analysis results, your testimonial requests, extracted quotable phrases, and your account statistics;
  • write — everything in read, plus creating testimonial requests (which can send an invitation email to a guest you name), approving testimonials, editing testimonial fields, and creating share links.

You agree that, as an MCP access user:

  • you will connect only assistants you trust, and only for your own account;
  • you accept that anything the assistant does with write scope has the same effect as doing it yourself — approving a testimonial makes it publishable, and creating a request can email a real person;
  • you will not let an assistant approve, publish, edit or share a testimonial in a way that breaches clause 5 or clause 6, and in particular will not use an assistant to rewrite a testimonial into something the guest did not say;
  • you understand that data the assistant reads leaves audesti and is handled by the assistant's provider under that provider's terms and privacy policy, not ours, and that we have no control over its retention or onward use there;
  • you will review and revoke connections you no longer need, which you can do at any time from the Connector page; revoking takes effect immediately for new calls.

Access tokens expire and refresh automatically while a connection is live. We may revoke a connection, or suspend connector access entirely, if it is used in breach of these Terms or threatens the Service.

Shared obligations. Across the API and the connector alike, you will not use them to build a product that substantially replicates the Service, to resell access, or to grant any third party access whose use would breach these Terms.

Widgets. Embed widgets are served from our infrastructure and may be cached at our edge. You may place them on sites you own or control. You may not alter the widget's markup or scripts to remove attribution, to strip the verified indicator, or to present testimonials as something other than what they are. On plans that do not include badge removal, the audesti badge must remain visible.

10Acceptable use

Part B of this document is the Acceptable Use Policy. It forms part of these Terms, and breaching it is a material breach.

11Availability and support

We aim to keep the Service available, but we do not commit to an uptime level and the Service is not offered with a service-level agreement. Maintenance, third-party outages and emergencies may interrupt it. Support is provided at the level stated for your plan, over email, during our business hours.

12Suspension and termination

You may cancel at any time from the billing page, and may delete your account from the account page.

We may suspend or terminate your access, with notice where practicable and immediately where not, if you materially breach these Terms or the Acceptable Use Policy, if your payment fails and is not cured, if your use threatens the security, integrity or lawful operation of the Service, or if we are required to by law. Where a suspension is curable, we will tell you what to fix.

On termination: your right to use the Service ends; we delete your content in the normal course as described in the Privacy Policy; and any fees already due remain payable. Clauses 7 (as to accrued rights), 8, 13, 14, 15, 16 and 18 survive.

13Disclaimers

To the fullest extent the law allows, the Service is provided "as is" and "as available", and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

We do not warrant that transcripts, translations or analyses are accurate or complete, that the Service will meet your requirements, or that content will never be lost — keep your own copies of anything you cannot afford to lose.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded, including the statutory rights of consumers.

14Limitation of liability

To the fullest extent the law allows:

(a) Neither party is liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost goodwill, lost business opportunity or the cost of substitute services, however caused and on any theory of liability.

(b) Each party's total aggregate liability arising out of or relating to these Terms and the Service is limited to the greater of (i) the fees you paid or owed us for the Service in the twelve months immediately before the event giving rise to the claim, and (ii) USD 100.

(c) The limits in (a) and (b) do not apply to: your obligation to pay fees; either party's liability for fraud or fraudulent misrepresentation; wilful misconduct; death or personal injury caused by negligence; your indemnity under clause 15; or any liability that cannot be limited under applicable law.

(d) Nothing here limits the rights of a consumer that cannot be limited by contract. If you contract with us as a consumer, clauses (a) and (b) apply only so far as the law of your country of residence permits.

These limits reflect the price of the Service and the allocation of risk both parties accepted in agreeing to it.

15Indemnity

You will defend and indemnify us against third-party claims, and the resulting liabilities, damages, settlements, costs and reasonable legal fees, arising from: your use of the Service in breach of these Terms or the Acceptable Use Policy; content you collect, publish or distribute; a claim by a guest relating to how their recording was obtained, used or published; and your breach of data protection, advertising or consumer-protection law.

We will notify you of the claim, give you control of the defence (with our consent to any settlement that admits fault or imposes an obligation on us), and co-operate at your expense.

16Intellectual property

The Service, its software, design, branding, documentation and trade marks are ours or our licensors'. Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not copy, modify, reverse-engineer, decompile, resell, sublicense or create derivative works of the Service, or use it to build a competing product, except to the extent that restriction is unenforceable under applicable law.

17Changes to these Terms

We may change these Terms. For changes that materially reduce your rights or increase your obligations, we will give at least 30 days' notice by email to your account address or by prominent notice in the app before they take effect. Other changes take effect when posted. Continuing to use the Service after a change takes effect means you accept it; if you do not, cancel before then.

The version and effective date at the top of this page identify the current text. We keep prior versions and will provide one on request.

18General

Governing law. These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of India, without regard to conflict-of-laws rules.

Jurisdiction. The courts at Kolkata, West Bengal, India have exclusive jurisdiction, and both parties submit to them. If you contract with us as a consumer, this does not deprive you of the protection of the mandatory law, or of the right to sue in the courts, of your country of residence.

Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.

Entire agreement. These Terms, with the documents incorporated into them, are the entire agreement between us on their subject matter and supersede any prior understanding. A purchase order or similar document of yours adds nothing.

Severability and waiver. If a provision is unenforceable, it is modified to the minimum extent needed to make it enforceable, or severed, and the rest stands. A failure to enforce a provision is not a waiver of it.

Force majeure. Neither party is liable for a failure to perform, other than to pay money, caused by an event beyond its reasonable control.

No third-party beneficiaries. No one other than you and us may enforce these Terms.

Notices. We give notice to your account email; you give notice to [email protected].

Part B

Acceptable Use Policy

Part B applies to everyone using audesti: account holders, their team members, anyone using the API, and any AI assistant connected through the MCP connector. Breaching it is a material breach of these Terms.

audesti exists so that real customers can say real things in their own voice, and businesses can show that honestly. Most of what follows is that single idea, spelled out.

19.1Testimonials must be real

You must not:

  • fabricate a testimonial, record one yourself as though you were a customer, or have an employee, contractor, affiliate or family member pose as an unconnected customer;
  • pay for, or offer anything of value in exchange for, a particular opinion or rating — you may thank someone for their time, but not for their verdict;
  • present a testimonial as independently verified beyond what it is: a recording made by someone you invited, who confirmed consent on the page;
  • edit, excerpt, caption, translate or arrange a testimonial so that it gives a misleading impression of what was said, including by cutting a qualification or reversing a comparison;
  • attribute a testimonial to a person, company or job title that is not theirs;
  • suppress testimonials selectively in a way that misrepresents overall sentiment, where you are presenting them as a representative sample;
  • reuse a testimonial given about one product to promote a materially different one.

Testimonial advertising is regulated in most markets. These rules are not ours alone.

19.2Guests must be treated properly

You must not:

  • invite someone you have no lawful basis to contact;
  • send invitations in bulk to purchased, scraped or harvested lists;
  • bypass, hide, pre-tick, reword or interfere with the consent step on the recording page;
  • open a recording link on someone's behalf, or let someone record in another person's name;
  • record a person who has not been told that they are being recorded;
  • publish on an audesti public page or share card without the guest's separate opt-in;
  • ignore a guest who asks you to take a testimonial down, including from a widget on your own website;
  • re-approach a guest who has declined publication in order to pressure them.

19.3Content limits

Do not collect, store, publish or transmit content that is:

  • unlawful, defamatory, harassing, threatening, or inciting violence or hatred;
  • sexually explicit, or involving a minor in any way;
  • infringing someone's intellectual property, privacy or publicity rights;
  • someone's sensitive personal data — health, biometric identifiers, financial account details, government identifiers, political or religious belief, sexual orientation, trade-union membership — whether spoken into a recording or typed into a field;
  • malware, or a link intended to deceive, phish or defraud.

audesti is not designed for sensitive categories of data, and nothing in it is built to handle them. Do not use it for health, legal, financial-advice or HR intake.

19.4No decision-making about people

You must not use audesti, or anything it produces, as an input to a decision about a person's employment, health, credit, insurance, housing, education, immigration status or legal rights, or any other decision with a legal or similarly significant effect. Sentiment scores and inferred outcomes are probabilistic inferences, not findings.

19.5Platform integrity

Do not:

  • probe, scan, penetration-test or attempt to breach the platform without our prior written permission;
  • circumvent authentication, rate limits, quotas, consent flows, bot filtering or the edge protections in front of the platform;
  • access another account's data, or try to;
  • scrape public pages or widgets at scale, or harvest guest names, companies or transcripts from them;
  • inflate view or play counts, or interfere with another account's statistics;
  • resell, sublicense or white-label access, or build a product that substantially replicates audesti;
  • remove the audesti badge on a plan that does not include badge removal, or alter widget markup or scripts to strip attribution or the verified indicator;
  • use the platform to send anything that would count as spam under applicable law.

19.6API and connected AI assistants

Everything above applies identically when an action is taken through the REST API or by an AI assistant connected over MCP. In particular:

  • an assistant with write access can approve testimonials, edit them, create share links, and send invitation emails to real people — you are responsible for every one of those actions as if you took it yourself;
  • do not use an assistant to rewrite a testimonial into something the guest did not say, to publish without the guest's opt-in, or to generate testimonial-style content that did not come from a real recording;
  • keep API keys and OAuth tokens confidential, and revoke connections you no longer need;
  • do not connect an assistant on behalf of an account you do not control.

19.7Reporting, and what we do about breaches

Report a suspected breach, an impersonated testimonial, or a security issue to [email protected]. Security researchers acting in good faith, who give us a reasonable chance to fix something before disclosing it, will not be pursued.

Where we see a breach we may, proportionately to it: ask you to fix it; unpublish or remove the content concerned; suspend a feature, an API key or a connector grant; suspend the account; or terminate it. For anything curable we will tell you what to fix and give you a chance to do it, unless the breach is serious, deliberate, repeated, or creates immediate risk to someone. Serious breaches — fabricated testimonials, recording people without telling them, publishing over a refusal — may end an account immediately and without refund.

We may report unlawful conduct to the authorities.

Part C

Refund & Cancellation Policy

Part C covers paid audesti subscriptions bought through Dodo Payments, our payment processor and merchant of record.

20.1Free plan

The Free plan costs nothing and needs no payment method. It includes a lifetime allowance of testimonials, not a monthly one, plus one extra for each successful referral. When the allowance is used up, you can keep using everything already in your account, but collecting more testimonials requires a paid plan. Nothing here is refundable, because nothing was charged.

20.2Subscriptions and renewal

Paid plans are sold as monthly or yearly subscriptions and renew automatically at the start of each period until cancelled. The price, interval and currency are shown at checkout and confirmed by email. Taxes are added where applicable.

20.3Cancelling

Cancel at any time from the billing page in your account. There is no cancellation fee and no notice period.

Cancellation stops the next renewal. It does not end the period you have already paid for: your plan stays active, with all its features and quota, until the end of the current billing period. After that the account reverts to the Free plan.

Your content is not deleted when a subscription ends. Testimonials, widgets and requests stay in the account. Features your new plan does not include stop working — for example, API and connector access, translation and badge removal — and the Free plan's lower limits apply from then on.

20.4Refunds

First purchase — 14 days. If you are unhappy with your first paid subscription on an account, tell us within 14 days of that first charge and we will refund it in full. You do not need to give a reason. This applies once per account.

Yearly plans — pro rata within 30 days. If you cancel a yearly subscription within 30 days of the charge, we will refund it in full. After 30 days a yearly term is not refundable, though you can cancel to stop the next renewal.

Renewals. Renewal charges are not generally refundable, because you were told the renewal date in advance and could cancel before it. Two exceptions, applied without argument:

  • you were charged after cancelling, or charged the wrong amount — we refund in full;
  • you did not use the account at all during the period just charged and you ask within 14 days of the charge — we refund in full.

Service failure. If a fault on our side made audesti substantially unusable for a meaningful part of a paid period, and we could not fix it in reasonable time, tell us and we will refund that period in full or in part, proportionate to the disruption.

Not refundable. Periods already used beyond the windows above; an account terminated by us for breach of these Terms or of Part B; and charges you dispute more than 90 days after they were made.

20.5Consumer rights

If you buy as a consumer rather than for a business, you may have statutory rights that are better than this policy — including, in the EU and UK, a 14-day right to withdraw from a distance contract. This policy never reduces those rights. Where a statutory right gives you more, it applies instead. By starting to use a paid plan immediately, you may be asked to acknowledge that supply has begun, which can affect a withdrawal right; we will still honour clause 4 regardless.

20.6How to ask

Email [email protected] from the address on the account. Tell us which account, which charge and, if it helps, what went wrong.

We reply within 5 business days. An approved refund goes back through Dodo Payments to the original payment method, usually within 5–10 business days of approval, depending on your bank or card issuer. We cannot refund to a different method.

If you would rather raise it with your bank first, please talk to us before starting a chargeback — a disputed charge suspends the account automatically while it is resolved, which is rarely what anyone wants.

20.7Price changes and plan changes

Upgrades take effect immediately. You are charged the difference for the remainder of the current period.

Downgrades take effect at the start of the next billing period. We do not refund the difference for the current one.

Price changes to an existing subscription take effect at the next billing period after at least 30 days' notice to your account email. If you do not accept a new price, cancel before it takes effect and you will not be charged it.

20.8Failed payments

If a renewal payment fails, Dodo Payments will retry. We will email you. If it is still unpaid after the retry window, the subscription lapses and the account reverts to the Free plan. Your content is not deleted. Settle the balance and the plan can be restored.
