Terms of Service

These Terms of Service ("Terms") govern access to and use of the platform operated by Beyondt Consultancy and Services ("Beyondt", "we", "us", or "our").

By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

1. Eligibility

  • You must be 18 years or older to use the platform.
  • If you use the platform on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

2. Platform Description

The platform allows users to:

  • Generate invitation links for speakers
  • Collect audio testimonials
  • Transcribe and analyze audio using automated artificial intelligence
  • Manage, display, and export testimonials and insights

Speakers submit recordings without creating an account.

3. User Responsibilities

You agree that you will:

  • Use the platform only for lawful purposes
  • Obtain all necessary permissions before inviting speakers
  • Not misrepresent, manipulate, or misuse testimonials
  • Not upload or distribute unlawful, misleading, defamatory, or infringing content
  • Comply with all applicable laws and regulations

You are solely responsible for how testimonials, recordings, and insights are used, published, or relied upon.

4. Speaker Consent

By generating invitation links, you confirm that:

  • Speakers are informed that their voice will be recorded and analyzed
  • Explicit consent is obtained through the platform's consent mechanism
  • You do not bypass or interfere with the consent flow

Beyondt is not responsible for consent obtained outside the platform.

5. Content Ownership and License

5.1 Ownership

  • Speakers retain ownership of their voice recordings.
  • Users retain ownership of testimonials they collect.

5.2 License to Beyondt

By submitting or collecting content, you grant Beyondt a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, process, transcribe, analyze, display, and use such content solely to operate, maintain, and improve the platform.

This license ends when content is deleted, except where retention is required by law.

6. Artificial Intelligence Disclaimer

  • All transcription and analysis is performed using fully automated AI systems.
  • AI-generated outputs are probabilistic, indicative, and non-deterministic.
  • Outputs may be inaccurate, incomplete, or misleading.

The platform must not be used for medical, psychological, legal, HR, employment, regulatory, or decision-critical purposes.

7. Payments and Billing

  • Paid features are billed via third-party payment processors.
  • Beyondt does not store payment card or banking information.
  • Prices, billing cycles, and subscription terms are shown at checkout.
  • All fees are non-refundable, unless explicitly stated otherwise.
  • Taxes or statutory charges (if applicable) are the user's responsibility.

Beyondt may modify pricing with prior notice.

8. Suspension and Termination

Beyondt may suspend or terminate access, with or without notice, if you:

  • Violate these Terms
  • Misuse the platform
  • Engage in unlawful, abusive, or harmful behavior

You may stop using the platform at any time.

9. Data Deletion

  • Users may delete content using platform controls.
  • Speakers may request deletion as described in the Privacy Policy.
  • Deleted data is permanently removed in accordance with the Privacy Policy.

10. Intellectual Property

  • The platform, software, branding, designs, and trademarks belong to Beyondt.
  • You may not copy, modify, reverse engineer, resell, or exploit the platform without written permission.

11. Third-Party Services

The platform integrates third-party services for AI processing, analytics, payments, and infrastructure.

Beyondt has no responsibility or liability for third-party services, including their availability, accuracy, security, or policies. Use of such services is governed solely by the third party's terms.

12. Disclaimer of Warranties

The platform is provided strictly on an "AS IS", "AS AVAILABLE", and "WITH ALL FAULTS" basis.

Beyondt expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, or error-free operation.

No information or advice obtained through the platform creates any warranty.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Beyondt shall not be liable for any damages whatsoever, including direct, indirect, incidental, consequential, special, punitive, or exemplary damages, loss of profits, loss of data, reputational harm, business interruption, or any other losses arising from or related to the use of or inability to use the platform.

This limitation applies regardless of the legal theory asserted and even if Beyondt has been advised of the possibility of such damages.

If any liability cannot be excluded under applicable law, Beyondt's total cumulative liability shall be limited to INR 1,000 or the amount paid by the user in the previous 12 months, whichever is lower.

14. No Responsibility for Decisions

Beyondt shall have no responsibility or liability for any decisions, actions, outcomes, or consequences taken by users or third parties based on:

  • Testimonials
  • Audio recordings
  • Transcriptions
  • AI analysis or insights

All reliance is at the user's sole risk.

15. Indemnification

You agree to fully indemnify, defend, and hold harmless Beyondt and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses, including legal fees, arising from:

  • Your use of the platform
  • Content you collect, publish, or distribute
  • Claims by speakers or third parties
  • Violation of laws or third-party rights

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the Kolkata High Court, Kolkata.

17. Changes to These Terms

Beyondt may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms.
